Terms of Use

Please read these Terms carefully before using Momentum Health 360 websites, apps, or related services.

These Terms of Use (“Terms”) govern your access to and use of the websites, online forms, communications, and related services operated by Momentum Health 360 (“Momentum Health 360,” “we,” “us,” or “our”). By accessing or using our services, you agree to these Terms. If you do not agree, please do not use our services.

If anything in these Terms is unclear, or if your situation is not clearly covered, please contact us before continuing.

Overview

What We Provide

Momentum Health 360 operates an online platform that may help you request telehealth evaluation and related support for wellness and weight-management programs. Depending on your location, health history, and clinical review, a licensed clinician may determine whether a treatment option is appropriate for you.

We do not guarantee that any particular medication, product, or program will be offered, prescribed, approved, shipped, or effective for you. Clinical decisions are made by licensed providers based on the information available at the time of review.

Eligibility

Who May Use Our Services

You may use our services only if you:

  • Are at least 18 years old (or the age of majority in your jurisdiction, if higher).
  • Can form a binding agreement under applicable law.
  • Provide accurate, complete, and current information during intake and account creation.
  • Use the services only for lawful purposes and only for yourself (unless we expressly allow otherwise in writing).

Availability of telehealth and related services may depend on your location and applicable laws. If you are unsure whether services are available where you live, please contact us.

Important

Not Emergency Care

Our services are not for medical emergencies. If you think you may be experiencing a medical emergency, call 911 (or your local emergency number) or go to the nearest emergency facility immediately.

Website content, FAQs, marketing materials, and general program descriptions are for informational purposes only and are not a substitute for professional medical advice, diagnosis, or treatment for your specific situation.

Telehealth

Telehealth Services and Limitations

If you request care through our platform, you may interact with licensed clinicians through secure video, messaging, questionnaires, or other remote methods permitted by law. Telehealth has limitations compared with in-person care, including limits on physical examination and technology constraints.

You are responsible for providing a private setting, working camera/microphone when required, and truthful health information. A clinician may decline to treat you, request additional information, recommend in-person care, or refer you elsewhere when appropriate.

You may withdraw consent to telehealth services at any time by contacting us or following the instructions provided during your care process. Withdrawal may affect pending orders or appointments; ask our team about timing and next steps.

Clinical care

Prescriptions and Treatment Decisions

Any prescription or treatment recommendation is made only if a licensed clinician determines it is clinically appropriate based on your submitted information and applicable standards of care. Completing a quiz, paying for a consult, or selecting a product on the website does not guarantee approval, a prescription, a specific medication, dosing, or shipment.

Results vary from person to person. We do not promise specific weight-loss amounts, timelines, or outcomes. Lifestyle, adherence, medical history, and other factors can affect results.

Medications and products offered through the platform may change over time. Product pages describe general options and should not be read as a personal treatment offer until a clinician evaluates you.

If you have questions about a specific medication, side effects, interactions, pregnancy/breastfeeding considerations, or whether treatment is right for you, discuss them with your clinician or contact us so we can help connect you with the right next step.

Your responsibilities

Accurate Information and Safe Use

You agree to:

  • Provide accurate medical history, medications, allergies, and contact details.
  • Promptly update information if your health status or contact details change.
  • Follow clinician instructions and pharmacy labeling for any prescribed medication.
  • Keep your account credentials secure and not share access with others.
  • Not misuse the platform (including fraud, harassment, scraping, or unauthorized access).

Providing false or incomplete information can delay care, affect clinical decisions, and may result in denial of services.

Orders

Payments, Shipping, Returns, and Cancellations

Pricing shown on the website is provided for convenience and may change. Taxes, shipping details, and plan options (if any) will be presented during checkout or consultation when applicable.

Because prescription products and clinical workflows are involved, returns and refunds are limited. Please review our current policy here:

Returns, Refunds, and Eligibility

If your question is not covered on that page, or if timing of cancellation is unclear in your case, contact us before your clinical review is completed whenever possible.

Accounts

Accounts and Communications

We may create or ask you to create an account to manage appointments, messages, orders, or support requests. You are responsible for activity under your account.

We may contact you by phone, text, email, or in-platform messaging about appointments, orders, care follow-up, or service updates. Message and data rates may apply for texts. You can ask us about communication preferences; some transactional messages may still be required to provide services you requested.

Privacy

Privacy and Health Information

How we handle personal and health information is described in our Privacy Policy / HIPAA privacy statement:

Privacy Policy

If you need a copy of records, have a privacy question, or want to understand a specific request, contact us and our team will guide you.

Website use

Intellectual Property and Acceptable Use

Site content, branding, logos, text, graphics, and design elements are owned by Momentum Health 360 or its licensors and are protected by applicable intellectual property laws. You may not copy, scrape, resell, or commercially reuse our content without prior written permission, except for personal, non-commercial viewing as needed to use the services.

You agree not to attempt to disrupt the website, bypass security, or use automated tools in a way that overloads or harms our systems.

Third parties

Third-Party Services

We may work with licensed clinicians, pharmacies, payment processors, shipping carriers, and technology vendors. Their services are subject to their own terms and applicable laws where relevant. We are not responsible for third-party websites linked from our site, and linking does not mean endorsement.

If an issue involves a pharmacy shipment, payment processor, or carrier, contact us first so we can help coordinate next steps when possible.

Disclaimers

Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES AND WEBSITE ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, AND WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

Nothing in these Terms is intended to limit rights that cannot be limited under applicable law, including any non-waivable consumer protections.

Liability

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOMENTUM HEALTH 360 AND ITS OFFICERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

Some jurisdictions do not allow certain limitations. If that applies to you, some of the above may not apply, and our liability will be limited to the fullest extent permitted by law.

If you believe you have a claim or unresolved issue, please contact us so we can attempt to resolve it directly.

Updates

Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised effective date when available. Continued use of the services after changes take effect means you accept the updated Terms. If a change is material and you have an active account or open care request, we may provide additional notice when practical.

If you do not agree to updated Terms, stop using the services and contact us about any open orders or care items.

General

Additional Terms

If any part of these Terms is found unenforceable, the remaining parts will continue in effect. Our failure to enforce a provision is not a waiver. These Terms, together with our Privacy Policy and any program-specific notices presented at checkout or intake, form the agreement between you and Momentum Health 360 regarding use of the website and related online services.

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules, except where mandatory local law requires otherwise. If you have a dispute, please contact us first so we can try to resolve it informally.
